On Thursday, the Chhattisgarh High Court acquitted a man of marital rape, ruling that sexual intercourse between lawfully married men and women is not rape, even if it is forced or against the wife’s will.
“Sexual intercourse or sexual act by a man with his wife, the wife not being under 18 years of age, is not rape,” the Chhattisgarh High Court said.
The complaint of a woman who claimed her husband of having sexual relations with her against her will did not hold up to legal examination, Mumbai Additional Sessions judge Sanjashree J Gharat had said earlier this month.
