The Supreme Court overturned an Allahabad High Court ruling granting Ashish Mishra bail in the case and returned the case to the Allahabad High Court to be heard again. The Supreme Court had previously expressed reservations over the Allahabad High Court’s decision to give bail to Ashish Mishra, stating that superfluous information like the autopsy analysis and severity of the wounds should not have been discussed until the trial had begun.
The special bench, which also included Justices Surya Kant and Hima Kohli, took significant notice of the fact that the state administration did not appeal the decision against the high court’s ruling, as the supreme court-appointed SIT had recommended.
