“High Courts must pass orders that are possible to implement”: Supreme Court

“High Courts must pass orders that are possible to implement”: Supreme Court

The Supreme Court advised today that the various High Courts that are dealing with Covid- related issues, must not pass any orders that are impossible to implement. An Allahabad High Court order stated that all the nursing home beds in Uttar Pradesh must have oxygen facility within four months. The High Court consequently administered the Uttar Pradesh government to ensure that every UP village should have two ambulances within a month with ICU facility.

A Supreme Court bench of Justices Vineet Saran and BR Gavai said today,”High Courts must pass orders that are possible to implement”. A two-judge bench of Allahabad High Court of Justices Siddharth Varma and Ajit Kumar had used a popular Hindi phrase “Ram Bharose” referring to the Uttar Pradesh’s medical system. The Supreme Court refused to cancel the comment, and said to take these observations as advise.
