The fight between West Bengal and the central government over the assembly elections in the state is not limited to the election arena alone. The backdrop of the legal battle between the CBI and the West Bengal government has been set in the Supreme Court.The West Bengal government filed a petition in the Supreme Court on Monday, challenging the CBI’s right to file a case for the coal smuggling case. This is the same case in which the wife of TMC MP Abhishek Banerjee has been questioned by the CBI. Abhishek Banerjee is the nephew of Chief Minister Mamata Banerjee.The Bengal government has requested the Supreme Court to stop the investigation of these cases until the CBI’s verdict of the validity of the FIR is reached. The state government’s petition states that the CBI is attempting to exclude investigations into these crimes by the state police, while in 2018, the state government revoked the consensus for a probe by the central agency.The CBI cannot assume that the case is about illegal mining of coal in the leasehold area of Eastern Coalfields Limited and some railway areas, hence the investigation is under its jurisdiction. While the state government through railway police force has the right of general policing.
