On Wednesday, the Supreme Court has sought detailed information from the Bombay High Court on the Skin to Skin Contact decision by the Supreme Court. In the case of Poxo’s acquittal from the Bombay High Court, the CJI said in the Supreme Court that detailed information will be summoned from the High Court. After this, the Supreme Court has stayed the acquittal of the accused while prohibiting this.Recently, the Bombay High Court has said in one of its orders that touching the breast of a minor without a ‘skin to skin’ contact will not fall under the category of sexual abuse under the POCSO (Protection of Children from Sexual Offences) Act.High court’s Nagpur bench judge Pushpa Ganeediwala, in her order passed on January 19, said that any molestation incident should be ‘skin-to-skin contact with sexual intent’ in order to classify any molestation incident as sexual abuse. He has said that groping a minor, ie grope, will not fall under the category of sexual abuse.
