SC prohibits Bombay HC verdict ‘Touching without skin to skin contact is not a sexual offense’

On Wednesday, the Supreme Court has sought detailed information from the Bombay High Court on the Skin to Skin Contact decision by the Supreme Court. In the case of Poxo’s acquittal from the Bombay High Court, the CJI said in the Supreme Court that detailed information will be summoned from the High Court. Explain that the Attorney General had taken up the matter in court. In this judgment, the accused was acquitted by the High Court, who was accused under Poxo, only on the basis that he did not have direct physical contact with the child. On this, the Attorney General raised the question, terming it dangerous. After this, the Supreme Court has stayed the acquittal of the accused while prohibiting this.Recently, the Bombay High Court has said in one of its orders that touching the breast of a minor without a ‘skin to skin’ contact will not fall under the category of sexual abuse under the POCSO (Protection of Children from Sexual Offences) Act.High court’s Nagpur bench judge Pushpa Ganeediwala, in her order passed on January 19, said that any molestation incident should be ‘skin-to-skin contact with sexual intent’ in order to classify any molestation incident as sexual abuse. He has said that groping a minor, ie grope, will not fall under the category of sexual abuse. Let me tell you that a 39-year-old man was sentenced by a session court to three years in the crime of sexually abusing a 12-year-old girl, which was modified by Ganeediwala.
