BJP leader Ashwini Upadhyay has filed a petition in the Supreme Court challenging the legality of the National Minorities Commission. The apex court is likely to hear it on Tuesday. In the petition, he has sought to define ‘minority’ and set guidelines for identification of ‘minority’ state-wise.
The BJP leader has said in the petition that according to national figures, Hindus are the majority community but in many states of the Northeast and in Jammu and Kashmir they are a minority.
The petition states that the Hindu community in these states is deprived of the benefits that are available to the minority communities here.
The petition states that according to the 2011 census eight states – Lakshadweep, Mizoram, Nagaland, Meghalaya, Jammu Kashmir, Arunachal Pradesh, Manipur and Punjab – have Hindu minorities but their minority rights are outlawed and arbitrary in the majority of those states. Is being grabbed by the Central and State Governments has not declared Hindus as minority under National Minorities Commission Act.
