The Supreme Court gave the Centre 24 hours to respond on whether it will issue orders to all states and union territories to put sedition proceedings on hold till the government’s scheduled exercise of reviewing Section 124A of the Indian Penal Code (IPC) is finished. On Wednesday, the Centre will respond.

 

Meanwhile, the Supreme Court agreed to the Centre’s request to postpone the case until the sedition statute was re-examined. Earlier, the court asked the Centre’s solicitor general, Tushar Mehta, how long it would take to rethink the sedition statute and how the government would deal with its misuse.

China on Friday formally revised a law to allow couples to have three children in an attempt to boost falling birth rates.

The amendment to the Population and Family Planning Law was passed at a session of the National People’s Congress, China’s parliament, and rolled out measures including tax breaks to encourage couples to have more children.

The amendment formally reverses China’s long-time policy of allowing most couples only one child.

In 2016, Beijing had scrapped its decades-old one-child policy to replace it with a two-child limit, which, however, had failed to lead to the expected upsurge in births.

China introduced the strictly implemented one-child policy in the late 1970s, which, estimates say, resulted in hundreds of millions of fewer births but left Beijing facing the problems of a rapidly greying society.

The amended law includes measures to provide affordable nursing services, and also to reduce the cost of births and education of children, such as allowing tax deductions.

The measures include cancelling the “social maintenance fee”, which was a financial penalty couples paid for having children beyond the limit.

The government will also encourage local governments to offer parental leave, increasing women’s employment rights and improving childcare infrastructure.

In the last five years since the Corporate Insolvency Resolution Process (CIRP) under the Insolvency and Bankruptcy Code 2016 came into existence , only 394 cases have managed to reach a resolution out of the 4,540 cases which have been admitted under it till June 30, 2021. 

According to data provided by the Ministry of Corporate affairs, the aggregate realisable amount from the 394 cases which have been resolved under CIRP is Rs.2.45 lakh crore . This amount pertains to financial creditors as well as banks. 

The Insolvency and Bankruptcy Code, 2016 (IBC) is a bankruptcy legislation , which was passed by the Parliament in May 2016 with the aim of creating a single law for bankruptcy and insolvency.

On Monday, Supreme Court Judge Justice Dr. Dhananjaya Yeshwant Chandrachud said Anti-terror law should not be “misused for quelling dissent”  , as he was addressing an event on the legal ties between India and the United States. 

“Criminal law, including anti-terror legislation, should not be misused for quelling dissent or harassment of citizens. As I noted in my judgement in Arnab Goswami vs the state, our courts must ensure that they continue to remain the first defense against the deprivation of liberty of citizens,” Justice Chandrachud said. 

He was speaking at the Indo-US Joint Summer Conference on Indo-US legal ties. 

“Deprivation of liberty for even a single day is one too many. We must always be mindful of the deeper systemic issues of our decisions,” he added.
