Gaurav Luthra and Saurabh Luthra, brothers and co-owners of the Goa nightclub where a devastating fire claimed 25 lives, arrived in Delhi on Tuesday after being deported from Thailand. Officials said the two were immediately handed over to Indian authorities upon landing and taken into custody for further legal proceedings.

Sources indicated that the accused will be produced before a Delhi court in the coming days. The December 6 blaze at the Birch by Romeo Lane nightclub in Arpora, North Goa, triggered widespread outrage and raised serious concerns over alleged fire safety violations and lapses by the management.

Investigators have registered a case of culpable homicide and negligence against the brothers, Gaurav Luthra, aged 44, and Saurabh Luthra, aged 40.

According to the probe, the nightclub was allegedly operating in breach of mandatory safety norms, which significantly contributed to the scale of the tragedy.

The deportation followed their detention in Phuket on December 11, after the Indian mission coordinated closely with Thai authorities. The Indian government had cancelled the passports of the two brothers and submitted a detailed dossier to Thailand, formally seeking their deportation in connection with the deaths.

An Interpol Blue Corner Notice was also issued against the Luthra brothers after they allegedly left India shortly after the incident. Meanwhile, Goa Police has already arrested five managers and staff members of the nightclub, with officials indicating that further arrests are possible as the investigation progresses.

In a related development, the Bombay High Court on Monday converted a civil suit against Birch by Romeo Lane into a public interest litigation, observing that “someone has to be held accountable” for the tragic loss of lives.

India and Thailand share an Extradition Treaty signed in 2013, which came into force in June 2015, providing the legal framework for cooperation in such cases.

The Bombay High Court, on Thursday, observed that there appeared to be some malafide intent behind the decision to scale down the security cover of Zeeshan Siddique, the son of the late NCP leader and former MLA Baba Siddique, who was killed in October last year.

A bench of Justices A S Gadkari and R R Bhonsale made the remarks while hearing a petition filed by Shehzeen Siddique, the widow of Baba Siddique, who sought the transfer of the murder investigation to an independent and impartial agency.

Zeeshan Siddique

Baba Siddique was shot dead by three attackers outside Zeeshan’s office in Bandra on the night of October 12, 2024. In her petition, Shehzeen stated that her husband had repeatedly voiced concerns about his safety and had requested the restoration of police protection in the weeks leading up to his death.

 

 

Following the murder, Zeeshan was granted police security after submitting a formal application. However, Shehzeen’s counsel, advocate Pradeep Gharat, told the court that the police scaled down Zeeshan’s security after the petition was filed.

The bench then directed the police to produce the Minutes of Meeting of the committee where the decision to reduce the security cover was taken.

Public prosecutor Mankunwar Deshmukh placed before the court a file containing threat perception reports(TPR) used by the police to assess whether to grant, modify or withdraw security protection. She denied that the reduction in security was linked to the filing of the petition.

The court nevertheless asked for specific details regarding when and how the decision to reduce Zeeshan’s security was reached.

Mumbai | The Bombay High Court, on Monday, instructed the Maharashtra government and the Election Commission of India to submit their responses to a petition demanding the registration of an FIR, against MNS chief Raj Thackeray over allegations that he assaulted individuals for not using Marathi.

The PIL was filed by advocate Ghanshyam Upadhyay, who asserted that Thackeray and members of his party had repeatedly targeted people, who do not speak Marathi and often focused on individuals, who migrated from other regions of the country. The petition also requested intervention and appropriate steps from the Election Commission.

Representing the petitioner, advocate Subhash Jha argued that such actions by the MNS typically escalate during the build up to elections.

A division bench of Chief Justice Shree Chandrashekhar and Justice Gautam Ankhad, ordered both the state government and the Election Commission to file their affidavits within four weeks.
The court also instructed the petitioner to remove references that label communities by region noting that the expression hate speech alone conveyed the point adequately.

According to the petition Raj Thackeray allegedly provoked acts of violence during a rally on July 5 by urging supporters to strike individuals who do not speak Marathi below the ear.

Mumbai | The long-delayed trial of Zabiuddin Ansari, also known as Abu Jundal, who allegedly trained the ten terrorists involved in the 26/11 Mumbai attacks in Hindi and local behavior, is set to resume after the Bombay High Court annulled a previous court order that required authorities to provide confidential documents to the accused.

Justice R N Laddha’s bench accepted the petition filed by the Delhi Police, the Ministry of Civil Aviation, and the Ministry of External Affairs, which had challenged the 2018 directive from the trial court. That order had instructed them to hand over certain classified documents requested by Ansari, putting the proceedings on hold for several years.

Government Challenge and Court’s Decision

The trial had remained suspended since 2018 as the authorities awaited a ruling on their petition. Solicitor General Tushar Mehta, representing the central government, argued that the trial court’s decision was legally flawed and should be overturned. The High Court agreed with this argument, allowing the case to move forward after a long pause.

Role of Ansari in the 26/11 Mumbai Terror Attacks

Ansari has been accused of playing a key operational role in the November 26, 2008 Mumbai attacks, which killed 166 people, including several foreigners. Investigators claim he not only helped plan the operation but also trained the Pakistani terrorists in Hindi and familiarized them with Mumbai’s geography so they could blend in easily.

The attackers arrived in Mumbai from the Arabian Sea, heavily armed, and unleashed a three-day siege across multiple locations. The only terrorist captured alive, Ajmal Kasab, was tried and executed in 2012 following his conviction by a special court.

Ansari’s Arrest and Legal History

Ansari had claimed he was arrested in Saudi Arabia before being deported to India, and had requested specific documents from the Mumbai special court to support his argument. In 2018, the court granted his plea, but the authorities objected and sought relief from the High Court, which has now quashed the earlier order.

The Delhi Police Special Cell maintains that Ansari, a Lashkar-e-Taiba member, was apprehended near Delhi airport. His name had also surfaced in intercepted communications from a Karachi-based control room that coordinated the 26/11 attacks.

Ansari was previously sentenced to life imprisonment in 2016 by a Maharashtra Control of Organised Crime Act (MCOCA) court for his involvement in the 2006 Aurangabad arms haul case. He had earlier escaped police custody, traveled to Bangladesh, and fled to Pakistan before being tracked down in Saudi Arabia. DNA tests matched his identity through samples taken from his family in Beed, Maharashtra, leading to his deportation to India in June 2012.

During interrogation, Ansari reportedly revealed details about his interactions with senior Lashkar commanders, including its founder Hafiz Saeed, and their efforts to expand recruitment through online networks.

The Delhi High Court said on Saturday that if an officer of the center, state or local administration is creating a bottleneck in the oxygen supply, “we will hang that person.”

  This has been said during the hearing of a petition of Maharaja Agrasen Hospital on behalf of the bench of Justice Vipin Sanghi and Justice Rekha Palli.  The hospital has moved the High Court regarding the lack of oxygen for critically ill covid patients.

 The court asked the Delhi government to tell who was obstructing the supply of oxygen, the bench said, “We will hang that person.”  We will not spare anyone. ”  

The court asked the Delhi government to inform the Center about such officials of the local administration so that they can take action against them.  The High Court also questioned the Center as to when it would get 480 metric tonnes of oxygen per day allotted to Delhi.


 The court said, “You assured us (on 21 April) that 480 metric tons of oxygen will be delivered to Delhi every day.”  Tell us when it will come? ”  The Delhi government informed the court that it has been getting only 380 metric tons of oxygen daily for the last few days and on Friday it had received about 300 metric tons of oxygen.  After this, the court questioned the Center.

 The Yogi Adityanath government of Uttar Pradesh has got a big relief from the Supreme Court.  The Supreme Court has stayed the order of the Allahabad High Court, which ordered the state government to impose lockdown in five cities of the state. 

 In its decision, the Supreme Court asked the state government to tell the Allahabad High Court in a week what steps it has taken to gain effective control over the corona infection.  The Supreme Court will now hear this after two weeks.
 Earlier, the Allahabad High Court’s decision to impose lockdown in 5 cities of Uttar Pradesh was challenged in the Supreme Court by Yogi Adityanath’s government.  

Solicitor General Tushar Mehta presented on behalf of the state government.  He had demanded a hearing on this matter on Tuesday, which was accepted by the Supreme Court.


 During the hearing, Solicitor General Tushar Mehta, appearing for the Uttar Pradesh government, argued that the High Court’s decision would cause problems in the general administrative process. 

 At the same time, in the petition filed by the state government, it was said that the Allahabad High Court should not interfere in policy decisions.

  The Supreme Court has also issued a notice to the petitioner seeking the lockdown, prohibiting the order of the High Court.  Explain that the High Court had ordered lockdown in five cities of the state including Varanasi and Lucknow.

 Meanwhile, regarding the order of Allahabad High Court, it has been said by the UP government that Corona cases have increased in the state and strictness is necessary for the control of Corona. 

 The government has taken many steps, further strict steps are being taken.  Along with saving lives, the livelihood of the poor also has to be saved. 

Therefore, the complete lockdown will not be done in the five big cities of UP.  If people are imprisoning themselves in many places, then there is no harm in us.

The Allahabad High Court has ordered the Uttar Pradesh government (UP Government) to lock-up five cities by April 26.  According to the High Court directive, all kinds of establishments in Prayagraj, Lucknow, Varanasi, Kanpur and Gorakhpur will be kept closed.


 ‘Consider a 15-day lockdown across the state’
 The Allahabad High Court has also asked the state government to consider a 15-day lockdown in the entire state.  The order of the High Court will be effective from tonight in these 5 cities. 

 That is, there is a complete lockdown order in Lucknow, Prayagraj, Gorakhpur, Kanpur and Varanasi from tonight itself.  This order has been given by the Division Bench of the High Court on Covid-19 in UP.  

The next hearing of the case will be held on April 26 at 11 am.  The Division Bench of Justice Siddharth Verma and Justice Ajit Kumar is hearing the case.

 The Allahabad High Court has issued strict instructions to the Uttar Pradesh government for the cities of Prayagraj, Lucknow, Varanasi, Kanpur Nagar and Gorakhpur regarding the growing corona infection.  Let’s know what the Allahabad High Court has said in its order-
 1. The High Court has said in its order that all the establishments, except the essential services including financial institutions, medical, health services, industrial, municipal and public transport will remain closed till April 26, 2021.


 2. No more than three people will be allowed at grocery stores and medical shops.  All hotels, restaurants and even small food centers at toll etc. will remain closed till April 26, 2021.


 3. All educational institutions, whether government or semi-government teachers and employees will also be closed till April 26, 2021.  This rule is for the whole of Uttar Pradesh.


 4. No social ceremonies will be allowed till 26 April 2021, including marriage ceremonies.  However, in case of pre-arranged marriages, permission can be taken from the DM of the district concerned.  

No more than 25 people will be allowed in the wedding ceremony.  The DM should take a decision only after considering the measures taken to prevent corona at his level.


 5. Any kind of public or religious activities should not be done till April 26, 2021.  All religious establishments are directed to remain closed till 26 April 2021.


 6. All the street vendors including fruits and vegetables, milk and bread vendors will be able to sell goods on the roads till April 26, 2021 till 11 am every day.


 7. Information about the Containment Zone should be given every day in two major Hindi and English newspapers in Prayagraj, Lucknow, Varanasi, Kanpur Nagar / Dehat and Gorakhpur districts.


 8. All types of public movement on the roads should be stopped and movement should be allowed only for medical help and emergency needs.


 9. Along with this, the High Court has instructed the state government to speed up the vaccination drive further.


 10. The High Court has today directed the Chief Secretary of Uttar Pradesh to send the DM of the respective districts to implement these instructions.

The Bombay high court on Friday refused to grant bail to lawyer and activist Sudha Bharadwaj, an accused in the Elgar Parishad-Koregaon Bhima case being probed by the National Investigation Agency.

A bench led by Justice RD Dhanuka rejected an appeal filed by Bharadwaj in June this year, whereby she had challenged a special court’s order that denied her bail on health grounds.

Bharadwaj, 58, had approached the HC seeking bail, saying that she suffered from chronic conditions such as diabetes and hypertension.

She had said these co-morbidities put her at a higher risk of contracting corona virus while at the Byculla women’s prison where an inmate had tested positive for COVID-19 earlier.

The court, however, noted the submissions made by the NIA and the Maharashtra government that the prison authorities were taking all precautions to prevent the spread of COVID-19, and that they were providing necessary medical care to Bharadwaj for her comorbidities.

NIA counsel, Additional Solicitor General Anil Singh, also told the court that if at any time, Bharadwaj’s condition needed further treatment or if she was required to be admitted to a hospital, even a private one, the state would provide for the same.

Bharadwaj has been lodged in the Byculla women’s prison since September 2018 following her arrest in the case.

The case pertains to the Elgar Parishad conclave held in Pune district on December 31, 2017. It is alleged that speeches made by some activists at the conclave led to violence near the Koregaon-Bhima war memorial on outskirts of Pune city the next day.

Social media platforms Facebook and YouTube on Monday told the Bombay high court that they would block access to their websites to an AIMIM supporter, accused of posting inflammatory content aimed at creating communal unrest, if the Union government or the court so orders.

A division bench of Chief Justice Dipankar Datta and Justice Madhav Jamdar was hearing a petition filed by Mumbai resident Imran Khan, seeking a direction to the police to take action against Abu Faizal for uploading incriminating hate speeches on social media.

The petitioner’s lawyer earlier said Faizal was a supporter of the Asaduddin Owaisi-led All India Majlis-e- Ittehad-ul-Muslimeen (AIMIM). The plea sought deletion of videos uploaded by Faizal and also a permanent ban to be imposed on him from all social media websites. In May this year, the high court ordered YouTube and Facebook to delete the videos uploaded by Faizal.

On Monday, Facebook’s counsel Darius Khambata and YouTube’s advocate Naresh Thacker informed the court that the videos uploaded by the user (Faizal) have been deleted. The petitioner’s advocate, Vivek Shukla, told the court that Faizal has uploaded videos even after his earlier clips were deleted.

“We (Facebook) can block access of the site to this user (Faizal) if the central government passes an order as per the procedure laid down under the Information Technology Act or if the court orders us to do so,” Khambata said.

Thacker, appearing for YouTube, conceded and said the URLs of the earlier videos uploaded by the user (Faizal) have been deleted. The bench sought to know from Shukla if the petitioner approached the nodal officer appointed by the government under the IT Act Section 69(A) (power to delete/block objectionable content posted online). “The IT Act has laid down a procedure by which any person can approach the nodal officer if he or she has a complaint against any content posted on the internet. Why should the court interfere and pass orders,” Chief Justice Datta said. The bench later reserved its order on the plea.
